1. Who these terms are with, and accepting them

Yield is published by Viacheslav Krivonosov, an individual developer established in Spain ("we", "us", "our"). Contact: viacheslav.krivonosov@gmail.com. Our trader details, including a postal address, are published with the app's listing on the App Store and Google Play.

These terms are the agreement between you and us for the Yield app and the site at yieldtodrive.com. By downloading, installing or using Yield you accept them. If you do not accept them, do not use the app. How we handle data is set out separately in our Privacy Policy, which forms part of these terms.

2. What Yield is, and what it is not

Yield is an entertainment and practice product: a driving game whose rules engine models United States traffic law, built so that you can rehearse right-of-way, lane discipline, signs, signals and speed in moving traffic and be told, immediately, when you get one wrong.

It is not:

• Driving instruction. We are not a licensed driving school and Yield is not a course. Playing it does not qualify you to drive.
• Legal advice, or an authoritative statement of the law in any jurisdiction.
• A substitute for your state's driver education requirements, its official driver handbook, a permit or license test, or supervised practice in a real vehicle.
• A guarantee of any result. We do not promise, and nothing in the app or on this site should be read as promising, that you will pass a permit test, a written test, a road test, or any other examination.

Traffic rules vary by state and change over time. We work hard to model them correctly and we fix errors when they are reported, but Yield may be incomplete, simplified for playability, or simply wrong for where you live. Always follow the actual law, the actual signs, and the instructions of a real instructor or law enforcement officer. Never rely on anything you learned here in place of checking your own state's handbook.

Never use Yield while operating a real vehicle, or in any situation where your attention is needed elsewhere.

3. Your license to use Yield

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use one copy of Yield on devices you own or control, for your own non-commercial use. You do not own the app; we license it to you, and we keep every right we do not expressly grant here.

4. What you may not do

• Copy, sell, rent, sub-license or redistribute the app or any part of it.
• Reverse engineer, decompile or disassemble it, except to the extent that applicable law expressly permits despite this restriction.
• Extract its artwork, code, sounds, text or other assets for use elsewhere.
• Modify or interfere with the app, or use automated means to play it or to send us data.
• Use the Dispute box to send anything unlawful, abusive, or containing other people's personal information.
• Use the app in a way that breaks any law that applies to you.

5. What you send us

If you report a disputed fault, you give us permission to read that report, act on it, and use it to improve the game's rules and its wording. Reports are treated as non-confidential; we may act on them without owing you anything or crediting you. Please do not include personal information — see the Privacy Policy for why.

6. Ownership

Yield — its name, its icon, its code, its artwork, its instructor character, its written material and its rules engine — belongs to us and is protected by copyright and other laws. Third-party components are used under their own licenses; the Poppins typeface is used under the SIL Open Font License. Trademarks and depictions of real road signage belong to their respective owners and are used descriptively.

7. Price, updates and availability

Yield is currently free and contains no in-app purchases, subscriptions or advertising. We may add them in a future version; if we do, they will be disclosed clearly before you are asked to pay anything, and this page and the Privacy Policy will be updated first.

We may update, change or discontinue the app or any of its features at any time. We do not guarantee that Yield will always be available, or that it will keep working on any particular device or operating-system version. Purchases, refunds and cancellations, if they ever exist, are handled by Apple or Google under the store's own terms — not by us.

8. No warranty

Yield is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, and specifically any warranty that the game's traffic rules are accurate, complete, or applicable in your jurisdiction. We do not warrant that the app will be uninterrupted or error-free.

Nothing here removes rights you have as a consumer that the law of your country of residence does not allow to be removed.

9. Limitation of liability

To the extent the law allows, we are not liable for indirect or consequential loss, loss of data, or loss arising from your reliance on the app's rules or feedback — including failing a test, or any incident that occurs while driving a real vehicle. Our total liability to you for any claim connected with Yield is limited to the amount you paid us for it, which for the current version is nothing.

We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

10. Additional terms for the Apple App Store

Yield is licensed under Apple's own Licensed Application End User License Agreement (the "Standard EULA"), which applies to every app distributed through the App Store. These terms sit alongside it. Where you obtained Yield from the App Store, the following also apply, and they override anything inconsistent above:

• Acknowledgement. This agreement is between you and us only, not with Apple. We alone are responsible for Yield and its content.
• Scope of license. Your license is non-transferable and permits use only on Apple-branded products you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you via Family Sharing or volume purchasing.
• Maintenance and support. We are solely responsible for any maintenance and support. Apple has no obligation whatsoever to furnish any maintenance and support services.
• Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. If Yield fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to Yield.
• Product claims. We, not Apple, are responsible for addressing any claim by you or a third party relating to Yield or your possession or use of it, including product liability claims, any claim that Yield fails to conform to a legal or regulatory requirement, and claims under consumer protection or privacy legislation.
• Intellectual property. If a third party claims that Yield infringes its intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.
• Legal compliance. You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.
• Third-party terms. You must comply with any applicable third-party terms of agreement when using Yield.
• Third-party beneficiary. Apple and Apple's subsidiaries are third-party beneficiaries of this agreement, and upon your acceptance of it Apple has the right — and is deemed to have accepted the right — to enforce it against you as a third-party beneficiary.
• Contact. Questions, complaints and claims about Yield should be sent to the developer named in section 1, at the email address given there.

11. Additional terms for Google Play

Where you obtained Yield from Google Play, your use is also subject to the Google Play Terms of Service. Google is not a party to this agreement and is not responsible for Yield, and any refund is handled under Google's own policies.

12. Ending this agreement

You may end it at any time by deleting the app. We may suspend or end your license if you materially break these terms. Sections 6, 8, 9 and 13 survive the end of this agreement.

13. Governing law

These terms are governed by the laws of Spain, and the courts of Spain have jurisdiction over any dispute arising from them.

If you are a consumer, this does not deprive you of the protection of the mandatory consumer-law provisions of the country where you live, and it does not prevent you from bringing proceedings in the courts of that country where the law gives you that right.

14. Changes to these terms

We may update these terms as the app changes or the law requires. The effective date at the top will change, and continuing to use Yield after an update means you accept the revised terms. If a change is material, we will make that clear on this page.

15. General

If any part of these terms is held unenforceable, the rest stays in force. Not enforcing a term at one moment does not waive it. These terms, together with the Privacy Policy, are the whole agreement between us about Yield.
